MPS meet Tim for more talks

After a review of the Victims' Charter, Tim Darby was invited to meet DCI Mark Cranwell and DI Will Reynolds, members of the MPS' Major Inquiries Central Specialist Crime division.
The constructive meeting at Jubilee House, Putney, south-west London lasted for almost two hours in which several aspects of new evidence was discussed.
“It went well,” Tim declared afterwards.

Cressida Dick's office responds

DI Akshay Chibber, Staff Officer to MPS Commissioner Cressida Dick, at New Scotland Yard responded to Tim Darby's follow-up email expressing his disappointment at not receiving a reply to his Feb. 8 letter. It read:
​
“Thank you for your email, received in the Commissioner’s private office today (Mar. 11). I am very sorry you did not receive a response to your last correspondence.
​
“I have forwarded your email to our Met Prosecutions Department, along with the head of Criminal Prosecutions for the MPS, as they would be best suited to review your concerns and provide you with an appropriate response.”

Tim appeals to Met Commissioner Cressida Dick

TIM Darby wrote to MPS Commissioner Dame Cressida Dick, drawing her attention to the wrongful conviction of Jason Moore for the murder of his brother Robert.​
​
He also raised the matter of the CPS withholding undisclosed evidence from both his and Moore's legal representatives.
He also expressed his concerns about the police handling of the case, as well as challenging the legality of the crucial ID evidence presented against Moore in court.

MPS Cold Case team say they won’t reinvestigate

ANOTHER kick in the teeth for Tim Darby, Jason Moore and justice. Tim’s December letter was forwarded to the Met Police’s Cold Case Homicide team for consideration but they, too, see no reason for Jason’s conviction to be overturned.
In response to Tim, DI Will Reynolds wrote: “The MPS does not seek to make any application to the Director of Public Prosecutions (DPP) based on the report provided by TM Eye. Our assessment is that there is nothing contained in the report that would leave us to believe that the original investigation was flawed or inadequate and there is nothing within it that could be considered new and compelling so as to give us concern that a miscarriage of justice had taken place.
“We have informed the CPS of our position and they are in agreement. We have asked that they consider make further contact with you. You may wish to liaise with the legal representatives of Jason Moore and perhaps make enquiries of the Criminal Cases Review Commission (CCRC) if you
feel so inclined. It may be that Jason Moore brings the matter to their attention. If directed by a higher authority or judicial court the MPS will naturally review its position.
“In summary the MPS cannot support and will not initiate any reinvestigation at this time, as we do not believe the report produced from TM Eye merits an application to the DPP for further investigative steps to be taken.”

CPS rebuff Tim Darby’s letter

THE CPS Homicide Team sent an unsigned written response to Tim Darby’s follow-up letter (dated December 2) regarding their failure to respond to Jason Moore’s solicitor’s request for disclosure. In layman’s terms, they basically said: ‘We won’t discuss this matter with you and, in any event, we’ve fully complied with our legal obligations’.

RESPONDING to Shearman Bowen’s letter dated September 15, 2020, Mr O. Sapanoglu, CPS lawyer, wrote: “We are mindful of our post-conviction disclosure obligations as endorsed in the case of Nunn (example attached), to disclose to the convicted defendant any material which has come to light which might cast doubt on the safety of the conviction. Your request has not provided a sufficient basis for identifying any such material.”

Jason Moore’s solicitor requests undisclosed evidence

SHEARMAN BOWEN & Co emailed a four-page letter to the Homicide Division of CPS, along with attachments consisting of TM Eye’s report, the chart graphic highlighting Jason Moore’s height compared to the three other men on the street, plus two exhibits which were Abdul Ahmed’s rough sketches of the crime scene. The letter drew specific attention to a list of 12 recommendations made by TM Eye around the serious issue of undisclosed material that could help to prove their client’s innocence.
